STATEMENT OF RESPONSIBILITY
It is clearly understood that First Century Voyages (FCV) has organized and marketed this trip in conjunction with Sea Cloud Cruises (SCC), St. Andrew Methodist Church (SAMC) and trip hosts Rev. Arthur and Becky Jones (AJ). FCV, SCC, SAMC, and all trip hosts and special guests do not assume any liability whatsoever for any injury, passenger accident or property loss to any passenger that may occur during the course of the trip, including travel between: North America and all destinations; land touring days in Turkey and/or Greece; time aboard the ship or its tenders; and shore excursions from the ship. First Century Voyages (FCV), Sea Cloud Cruises (SCC), St. Andrew Methodist Church (SAMC) and hosts and special guests are not responsible for any loss of any kind arising from the actions of the ship owner and operator, touring coach owners and operators; local agents, shoreside physicians, independent contractors, or other transportation companies in connection with the trip, whether on or off the vessel or any other ship, train, plane, motorcoach, or other conveyance.
The ship is owned by Hansa Cloud Sailing Ltd. and is represented and operated by their agent, Sea Cloud Cruises GmbH (SCC). FCV acts only as an agent for the passenger with respect to transportation and ship arrangements and exercises appropriate prudence and all care possible in doing so. However, FCV is in no way responsible for the actions of SCC, local agents, and other transportation companies who provide conveyance during this trip.
Each passenger agrees to be bound by the terms and conditions of the passage contract issued by SCC, copies of which may be requested in advance. That passage contract limits the responsibility of FCV and its agents, the ship’s owners and their agent (SCC), and the Master and officers of vessels used for passage (referred to as Companies) as follows: (1) Companies are not responsible for proven loss or damage to passenger baggage. Money, jewelry, cameras, optical devices, prescription medications, watches, precious metals, or electronics are not baggage and are carried at passenger’s sole risk with no liability to Companies. (2) Companies are not responsible for personal injuries, illness or death resulting from any peril of the seas or cause not within Companies’ direct and sole control, or not resulting from the sole and direct negligence of Companies. Companies are not responsible for injuries, illness or death occurring off the vessel during pre-cruise or post-cruise land touring days or during shore excursions from the vessel. (3) Companies may refuse to transport or may disembark any passenger for: illness; disease; injury; mental problems; vulgar or improper conduct; conveyance or use of illegal drugs, marijuana, or controlled substances of any kind; refusal to obey regulations; or for danger to self, other passengers, or the crew. Such passengers shall bear all expenses related to the refused passage or early disembarkation. (4) Though every reasonable effort is made to adhere to the advertised itinerary, safety is of paramount importance and Companies may change the itinerary for just cause, including the inadvisability of using the ship’s tenders for shore visits when the sea conditions are deemed by the Captain to be unsafe, and no compensation is due to passengers for ports missed or changed due to such causes. (5) Each passenger is responsible for timely arrival at the vessel before each departure, with passage hire fully earned if a departure is missed, unless caused by the sole negligence of Companies. (6) Companies are not responsible for any loss resulting from air transportation delays, missed flight connections, flight cancellations, or any air carrier's cancellation penalties incurred by a passenger's election to purchase non-refundable air tickets in connection with this program. (7) Companies may cancel or withdraw any cruise/tour or portion thereof with a refund based on the actual cost of the unfinished portion of the published program.
On advancement of deposit and final payment to FCV, the depositor agrees to be bound by the Terms and Conditions mentioned here and on the back cover of the trip brochure. Any third person signing the reservation form or this form signs as an agent for such passenger.
